TERMS AND CONDITIONS OF CARRIAGE

IMPORTANT NOTE

– 1. Customs, Exports and Imports

PRIME LOG SOLUTIONS can perform any of the following activities on behalf of the sender in order to provide its services to Shipper: (1) complete any documents, adjust the codes of products or services, and pay any required fee or tax under the laws and regulations force, (2) act as agent Sender for customs purposes and control of exports and imports, and as Recipient solely for the purpose of appointing a customs broker to perform customs clearance and entry; and (3) redirect the Shipment to the Recipient’s import broker or other address upon request of any person who PRIME LOG SOLUTIONS believe in its reasonable opinion to be authorized to do so.

– 2. Unacceptable Shipments

The Shipper agrees that its Shipment is deemed unacceptable for transportation if:

  • is classified as hazardous material, dangerous goods, prohibited or articles restricted by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), ADR (Regulation European Road Transport for Dangerous Goods), or by any other government department or other relevant organization; no customs declaration, when so required by applicable customs regulations is not made;
  • contains counterfeit goods, animals, bullion, coins or paper money, banners / decals / revenue stamps, negotiable instruments payable to the bearer, precious metals and stones; real firearms or imitation, the same parts, weapons, explosives and ammunition; human tissue, pornography or

narcotics / illegal drugs);

  • contains any other item that the PRIME LOG SOLUTIONS judge that can not be carried safely or legally, or
  • the packaging is defective or is inadequate.

– 3. Delivery Items and Non-Deliverable

Shipments can not be delivered to PO boxes or postal codes. Shipments will be delivered to the recipient’s address provided by the sender, but not necessarily “hands on” Recipient. Shipments to addresses with a central receiving area will be delivered in the area. If the Shipment is deemed unacceptable, or it has been undervalued for customs purposes, or the Recipient can not be reasonably identified or located, or the Recipient refuse to receive or to pay for delivery, PRIME LOG SOLUTIONS should apply reasonable efforts to return the Shipment to Shipper at the expense of the sender, failing which the Shipment may be discarded or sold by PRIME LOG SOLUTIONS, without this incurring any liability or duty to indemnify, of any kind,

– 4. Inspection

PRIME LOG SOLUTIONS have the right to open and inspect a Shipment without the need for prior notification or permission.

– 5. Shipping Exchange

The amount of freight is calculated according to actual weight or cubed, whichever is greater. Any Shipment may be weighed or measured again by PRIME LOG SOLUTIONS to confirm this calculation. – 7. Deadline for Claims

All claims must be submitted in writing to PRIME LOG SOLUTIONS within 30 (thirty) days from the date on which the PRIME LOG SOLUTIONS accepted the Shipment, failing which the PRIME LOG SOLUTIONS shall have no liability of any kind. In order to assess any claim for damages or losses, the contents of the original order should be made available to PRIME LOG SOLUTIONS for inspection. PRIME LOG SOLUTIONS is not responsible for robbery or theft.

– 8. Insurance for shipments *

PRIME LOG SOLUTIONS can provide protection to the sender covering the real value of your shipment in relation to physical loss or damage during transportation. – 9. Late Shipments and Money-Back Guarantee

– 12. Warranties and Indemnity Shipper

– 13. Forwarding

The sender agrees with any routing and diversion, including the possibility that the consignment can be transported through intermediate stop locations.
